Before we proceed to explain the process of Divorce by way of Mutual Consent, it is important to point out here that wherein both the parties are engrossed in a Divorce battle, and either due to the intervention of the Court, Mediation, Conciliation or any 3rd factor, the parties decide to part ways by Mutual Consent, in that scenario, the Contested Divorce Petition is to be withdrawn on the basis of the settlement and divorce by way of mutual consent has to be applied before the concerned Court. Harveen Kaur<\/em><em>.\u00a0<\/em><\/a>The Hon`ble Supreme Court held that this mandate for waiting period was found to be causing hardships in certain cases. The Court further<em>\u00a0<\/em>held that the six months waiting period as prescribed under Section 13B(2) of the HMA is not mandatory and that the same can be waived by the Family Court in exceptional circumstances.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<div id=\"gdlr-core-column-2\" class=\"gdlr-core-pbf-column gdlr-core-column-60 gdlr-core-column-first\">\n<div class=\"gdlr-core-pbf-column-content-margin gdlr-core-js \">\n<div class=\"gdlr-core-pbf-column-content clearfix gdlr-core-js \">\n<div class=\"gdlr-core-pbf-element\">\n<div class=\"gdlr-core-text-box-item gdlr-core-item-pdlr gdlr-core-item-pdb gdlr-core-left-align\">\n<div class=\"gdlr-core-text-box-item-content\">\n<h3>The factors which will warrant the waiving of the waiting period are<\/h3>\n<ul>\n<li>The statutory period of six months specified in Section 13B(2), in addition to the statutory period of one year under Section 13B(1) of separation of parties is already over before the first motion itself;<\/li>\n<li>All efforts for mediation\/conciliation including efforts in terms of Order XXXIIA Rule 3 CPC\/Section 23(2) of the Act\/Section 9 of the Family Courts Act to reunite the parties have failed and there is no likelihood of success in that direction by any further effort;<\/li>\n<li>The parties have genuinely settled their differences including alimony, custody of child or any other pending issues between the parties;<\/li>\n<li>The waiting period will only prolong their agony;<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div id=\"gdlr-core-column-3\" class=\"gdlr-core-pbf-column gdlr-core-column-60 gdlr-core-column-first\">\n<div class=\"gdlr-core-pbf-column-content-margin gdlr-core-js \">\n<div class=\"gdlr-core-pbf-column-content clearfix gdlr-core-js \">\n<div class=\"gdlr-core-pbf-element\">\n<div class=\"gdlr-core-text-box-item gdlr-core-item-pdlr gdlr-core-item-pdb gdlr-core-left-align\">\n<div class=\"gdlr-core-text-box-item-content\">\n<h2>Legal Grounds for Statutory Gap Waiver<\/h2>\n<p>The bench in<em>\u00a0<\/em>further held that the Court should consider the following questions :<\/p>\n<p><em>(i) How long parties have been married?<\/em><\/p>\n<p><em>(ii) How long litigation is pending?<\/em><\/p>\n<p><em>(iii) How long they have been staying apart?<\/em><\/p>\n<p><em>(iv) Are there any other proceedings between the parties?<\/em><\/p>\n<p><em>(v) Have the parties attended mediation\/ conciliation?<\/em><\/p>\n<p><em>(vi) Have the parties arrived at genuine settlement which takes care of alimony, custody of child or any other pending issues between the parties?<\/em><\/p>\n<p>The bench also noted that in\u00a0<em><a href=\"https:\/\/main.sci.gov.in\/supremecourt\/2021\/29132\/29132_2021_38_3_32025_Judgement_11-Dec-2021.pdf\" target=\"_blank\" rel=\"noopener\">Amit Kumar v. Suman Beniwal (2021)<\/a>,\u00a0<\/em>a two-judge bench held that in addition to the factors mentioned in\u00a0<em>Amardeep Singh,\u00a0<\/em>the Court should also ascertain whether the parties have freely, on their own accord, and without any coercion or pressure arrived at a genuine settlement which took care of the alimony, if any, maintenance and custody of children, etc.<\/p>\n<p><img
